There is no exhaustive list of offenses or irregularities that can constitute the subject of whistleblowing. Reports concerning behavior, risks, crimes or irregularities to the detriment of the public interest are considered relevant.

Whistleblowing does not concern complaints of a personal nature of the reporting party, usually governed by other procedures.

The illicit conduct reported must concern situations of which the reporting party has become aware directly or indirectly, even casually, due to the employment relationship and the role held.

However, reports based on suspicion or gossip cannot be considered worthy of protection as it is necessary to take into account the interests of the third parties subject to the information reported in the report and at the same time prevent the administration or body from carrying out internal inspection activities which they risk being of little use and in any case wasteful.

Finally, the requirement of the truthfulness of the facts to protect the reported person remains unchanged.
